Special Cases &
Complex Situations

Not every immigration situation fits neatly into a standard visa category. Overstays, prior declines, criminal history, medical issues, and broken relationships all create complications that require specialist knowledge and careful case preparation.

Who This Is For

When Standard Doesn’t Apply

Immigration New Zealand has clear rules — but real life is rarely straightforward. A previous visa decline, an unresolved overstay, a health condition, a complicated relationship, or a change in circumstances can each turn an otherwise simple application into a high-stakes exercise.

Complex cases aren’t declined more often because they’re impossible — they’re declined more often because they’re handled incorrectly. The way a case is framed, evidenced, and presented to INZ is often the difference between an approval and a refusal.

Don’t Apply Without Getting Advice First

If you have been declined before, breached a visa condition, have a criminal conviction, or have a health condition that may be flagged, submitting another application without professional guidance significantly increases your risk of a second refusal — and may trigger a stand-down or ban. A free initial consultation costs nothing. A second decline can cost you years.

⚠️
Prior Decline
A refused application affects your immigration history and must be disclosed.
🔒
Visa Conditions
Breaching any condition (overstay, working without permission) creates deportation liability.
🏥
Health Issues
Certain conditions trigger automatic health flags requiring a waiver application.
⚖️
Criminal History
Convictions must be disclosed. Whether they affect your visa depends on type and sentence.

Situations We Handle

Complex Cases We Specialise In

These are the situations where getting it right matters most — and where a licensed adviser’s involvement makes the biggest difference to the outcome.

🚫

Previous Visa Decline

A prior refusal does not permanently bar you from applying again — but it must be disclosed and the reasons for the decline directly addressed. We review the original decision, identify what was wrong, and prepare a substantially stronger reapplication.

⏱️

Overstay & Visa Breach

Overstaying a visa or breaching conditions (such as working beyond permitted hours) creates deportation liability. Options vary depending on how long the breach has occurred and your current circumstances — early advice is critical before INZ takes action.

⚖️

Criminal History & Character

Convictions must be declared on all applications. Whether they trigger a character concern depends on the offence type, sentence length, and time elapsed. We assess your specific history against INZ’s character requirements and advise whether a character waiver is viable.

🏥

Medical Waivers

Certain health conditions — including tuberculosis history, some chronic conditions, or significant treatment costs — can trigger a health flag. A medical waiver requires compelling evidence that the benefit of granting the visa outweighs the public health and cost concern.

💔

Relationship Breakdown

If your visa is tied to a partner and the relationship ends, your immigration status becomes vulnerable. Depending on your situation, there may be pathways to remain — including domestic violence provisions, employer-based alternatives, or other residence streams.

🔄

Deportation & Removal

If INZ has issued a deportation liability notice or a removal order, urgent professional representation is required. Depending on circumstances, it may be possible to appeal, apply for a special direction to stay, or pursue a residence pathway that removes the liability.

Our Approach

How We Handle Difficult Cases

Complex immigration cases require more than form-filling — they require a thorough understanding of the law, INZ’s decision-making patterns, and how to frame evidence compellingly. Our approach is honest, methodical, and focused on your best realistic outcome.

We will always tell you if we believe your case is not viable. We won’t take your money to pursue an application that we believe will fail — but we will work hard to find every viable avenue that exists for your situation.

1

Full Case Review

We review your entire immigration history, any prior decisions, and the facts of your situation before forming any view on strategy.

2

Honest Risk Assessment

We give you a frank assessment of the risks, the realistic chances of success, and what the consequences of each option are.

3

Strategy Development

We identify the strongest legal basis for your application and determine what evidence is needed to address every concern INZ is likely to raise.

4

Evidence Building

We work with you to gather, organise, and present evidence that directly addresses each risk factor — including statutory declarations, supporting letters, and expert reports where needed.

5

Application Submission

We prepare and submit the application with a detailed covering submission that pre-emptively addresses the concerns we anticipate INZ will raise.

6

Ongoing Representation

We respond to any INZ queries, RFIs, or interviews on your behalf — and advise on next steps if an appeal or reconsideration becomes necessary.

Why Licensed Representation Matters in Complex Cases

  • INZ officers can see your full visa history
  • Prior declines can narrow future options
  • Incorrect disclosures can bar you permanently
  • How evidence is presented affects outcomes
  • Submissions can pre-empt and neutralise objections
  • Licensed advisers are legally accountable to you

FAQ

Common Questions

I was declined before. Can I apply again?

In most cases, yes — but only if the reasons for the original decline have been resolved or can be substantively addressed. Simply reapplying with the same information will almost always result in the same outcome. We review the original decision in detail and only advise reapplication when we believe there is a genuine basis to succeed.

I have overstayed my visa. What are my options?

Options depend on how long the overstay has been and your current circumstances. Some people may be eligible to apply for a new visa from within New Zealand despite the overstay. Others may need to leave first. In some cases, deportation liability can be resolved through a successful residence application. Do not wait — the longer an overstay continues, the fewer options remain.

Will a criminal conviction automatically result in a visa refusal?

Not automatically. INZ applies a character test based on the nature of the offence, sentence length, and time elapsed. Minor or historical convictions often have little impact. More serious convictions require a character waiver — a formal request for INZ to exercise discretion. We assess your specific history and advise on the likelihood of a waiver being granted.

My relationship has ended and my visa depended on my partner. What happens now?

Your options depend on what type of visa you hold and whether you have other eligibility. If you experienced family violence in the relationship, specific provisions may allow you to apply for residence independently. If you have employment, the AEWV pathway may be available. We urgently assess your situation and advise on every available option to protect your status.

Can you appeal a visa refusal?

Some refusals can be appealed to the Immigration and Protection Tribunal (IPT) or reconsidered by INZ. The right to appeal depends on the type of application and the grounds for refusal. We advise on whether an appeal is available, whether it is likely to succeed, and whether a fresh application might be a faster or stronger route.
